Child Care Law
At Berry Redmond Gordon and Penney Solicitors, we understand the anxiety and stress that can come with Local Authority involvement in your family’s affairs. Our experienced family lawyers are here to offer support, guidance, and empathy during this difficult time. Vicky Shufflebottom, a qualified solicitor since 2007 and a member of the Law Society’s Children Panel, specializes in child care law.
Who Are Social Services?
Social Services (also known as Local Authority or Children’s Services) are a government body responsible for safeguarding and promoting the welfare of children. If Social Services become involved, a Social Worker will be assigned to work with your family throughout the process, offering guidance during assessments, inquiries, and court proceedings. It is vital that parents engage with Social Services and cooperate with any recommendations.
Public Law Outline (PLO) Meetings
If Social Services have concerns about your child’s welfare, they may invite you to a formal meeting known as a Pre-Proceedings or Public Law Outline (PLO) meeting. This meeting aims to resolve concerns and avoid court action. If you receive an invitation to a PLO meeting, we can attend with you and provide free legal advice.
Care Proceedings
If the Local Authority has serious concerns about a child’s safety, they may initiate Care Proceedings. These proceedings can start urgently, and we are here to guide and support you through this often-worrying process.
How Long Do Care Proceedings Take?
Care proceedings must conclude within 26 weeks. Extensions beyond this period can only be granted if necessary for a just outcome.
Who Will Be at the Court Hearings?
Parents, as well as anyone with parental responsibility, will be required to attend court hearings, along with the Local Authority, who will present their case. A Children’s Guardian and solicitor will represent the child’s interests, while a judge will review the evidence and make a decision.
